RULES OF THE CONTEST
Article 1 : Organisation
The Louis Vuitton Foundation, referred to hereafter under the name "The Organiser", whose registered office is located at 8 avenue du Mahatma Gandhi, Bois de Boulogne, PARIS 16, identified under SIREN (French business registration) number 494 685 761, is organising a free game with no obligation to buy (hereafter "the Competition") from September 22, 2017 12pm (French time) to September 25, 2017 5pm (French time), in accordance with the terms and conditions of these rules.
Apple is not involved in this contest.
Article 2 : Participants
This free game, with no obligation to buy, is open to people of legal age or minors, resident in France or any other country, who have downloaded the free "Lucky Vibes" mobile application (available in French and English) (hereafter "The Application").
Excluded from the game are members of the staff of "The Organiser" and any people who have directly or indirectly been involved in the design, the production or the management of the game as well as their spouse and the members of their families: direct ascendants and descendants or other relatives living under their roof or not.
"The Organiser" reserves the right to ask any participant (hereafter the "Participant" or "Player") to prove compliance with the conditions set out above. Any person who does not meet these conditions or who refuses to prove them shall be excluded from the Competition and may not, in the event of a win, be entitled to his/her prize. "The Organiser" reserves the right to carry out any check concerning compliance with this rule.
Participation in the game means full acceptance of these rules.
Article 3 : Terms and Conditions of Participation
To take part in the Competition, the Player must click on the "Competition" module visible on the Application's home screen during the days of the contest (the "Competition" module is activated when it appears in green on the screen and is deactivated when it is greyed out). The terms and conditions of the contest will be displayed on the Application's home screen.
At the time of his/her initial participation, the Player must complete a registration form by filling in the mandatory fields (email address, verification of the email address) and accept the rules of the Competition. The Participant must fully and correctly complete the information form for his/her registration to be validated. The Participant is advised and accepts that the information entered in the registration form equates to proof of his/her identity.
The winners of the Competition will be the first fifty (50) Players who have achieved the highest score during the period of time that the Competition lasts.
The Participants will have the possibility of playing again as many times as they want to during the period of the Competition in order to improve their score. Each Player's best score will be saved in the ranking.
The Player's best score and his/her ranking will be displayed on the Application's home screen from the start to the end of the Competition.
If the Player agrees to receive messages from the Application, he will be advised by "push" notifications:
- of the start of the Competition,
- of his/her best score being beaten by another Participant,
- of a change in his/her ranking,
- of the end of the Competition.
The Participant must fully and correctly complete the information form for his/her registration to be validated. The Player is advised and accepts that the information entered in the registration form equates to proof of his/her identity.
Any participation carried out contrary to the provisions of these rules will render the participation invalid. Any Participant suspected of fraud may be removed from the contest by "The Organiser" without it having to justify this. Any incomplete, incorrect or illegible identification or participation, whether this is done voluntarily or not, or carried out in another form than that provided in these rules, will be deemed null and void. The same sanction will apply in the case of multiple participation.
Article 4 : Winnings
The prizes to be allocated are Fifty (50) priority invitations for 2 persons to visit the exhibition "Being Modern: MoMA in Paris" during the hours that it is open to the general public (Hereafter the "Prize").
A single invitation will be awarded per winner. The Prize is provided by the Louis Vuitton Foundation.
Article 5 : Declaration of the Winners
"The Organiser" undertakes to send the list of the ranking at the end of each Competition.
The winners will be the Players who have achieved the highest scores.
Article 6 : Announcing the Winners
The winners will be advised by an email from "The Organiser" sent to the email address indicated when taking part in the contest.
This email will advise the winners of the following arrangements to receive their Prize:
- opening date and time
- meeting place
Article 7 : Presentation of the Prizes
The winners undertake to accept the Prizes as offered without the possibility of exchange, particularly for cash, other goods or services of any sort whatsoever, or transfer of the benefit to a third party. Also, these Prizes may not be subject to requests for offsetting.
In the event of the occurrence of an event outside of its control, in particular linked to its suppliers or to unforeseeable circumstances, "The Organiser" reserves the right to replace the Prizes announced with prizes of equivalent value. The winners will be advised of any changes.
Article 8 : Use of the Participant's Personal Data
The Participants' information is stored and used by "The Organiser" to memorise their participation in the contest and to enable the Prizes to be awarded.
The Participants can, for legitimate reasons, object to this personal data passed on in respect of this game being processed. They also have a right to object to such data being used for marketing purposes, other than the participation in this contest, which they can assert as soon as their participation is registered by sending a letter to
"The Organiser" whose address is mentioned in Article 1.
The winners authorise "The Organiser" to use their contact details (first name, surname) for publicity or public relations purposes, on any medium whatsoever, without this entitling them to any payment, right or benefit whatsoever, other than the awarding of their Prize.
The Participants have the choice of ticking the “I want to receive the newsletter from the Louis Vuitton Foundation” box. For the Participants who have ticked this box,
"The Organiser" will send their email address to the Louis Vuitton Foundation and they will be able to subscribe to the Louis Vuitton Foundation's newsletter. The Louis Vuitton Foundation undertakes not to pass on the contact details of the Participants who have ticked this box to a third party.
In accordance with the French Data Protection and Civil Liberties Act (Loi Informatique et Libertés) of 6 January 1978, any Participant is entitled to demand that the information concerning him/her which is inaccurate, incomplete, ambiguous or out of date be rectified, added to, clarified, updated or deleted, by sending a letter to "The Organiser" whose address is mentioned in Article 1.
Article 9 : Reimboursement of Expenses Associated with the Game
The expenses associated with the game will be reimbursed in accordance with the conditions described below:
Access to the Application and participation in the game are entirely open and free, so the expenses for connecting to the Application, incurred by the Participant, will be reimbursed to him/her in accordance with the terms and conditions below.
"The Organiser" retains a record, for each Participant, of the dates and times that he/she connects to and disconnects from the site, and also the connection time.
A single reimbursement per month and per household (same surname, same postal address) is allowed, provided that the Participant is resident in France and is within the normal conditions of use of the Application, with it being made clear that it is expressly agreed that a normal use of the Application cannot exceed 15 minutes per day.
Given that, in the current state of servicing and technical offers, some Internet service providers offer a free or fixed price connection to Internet users, it is expressly agreed that any access to the Application effected on a free or fixed price basis (such as, inter alia, connection by cable, ADSL or dedicated line) may not give rise to any reimbursement, provided that the subscription to the service provider's services is, in such a case, signed up for by the Internet user for his/her use of the Internet in general and that the fact that the Participant connects to the Application and takes part in the game does not cause him/her any additional expense or disbursement.
In the case of a fee-based connection invoiced at pro rata of the period of time online, the expenses for connecting to the Application to take part in the game will be reimbursed by cheque, on request from the Participant sent in the month of the disbursement of those expenses, with the postmark being deemed conclusive proof, within two months of receipt of the Participant's request.
In the case of a connection forming part of a fixed price for a specific period and, beyond that period, invoiced at pro rata of the period of time online, the expenses for connecting to the Application will be reimbursed to the Participant if it is established that the Participant has exceeded the fixed price allowance that he/she had and that said allowance was exceeded as a result of connecting to the Application. To obtain reimbursement of his/her connection expenses, and also the postal expenses of his/her reimbursement request, the Participant must send
"The Organiser" a written request, issued on plain paper, containing the following information:
- his/her first name, surname and home postal address
- the dates, times and periods of his/her connections to the Application
- a copy of the detailed invoice from the telephone operator and/or the Internet service provider with which he/she is subscribed, showing the dates and times of his/her connections to the Application.
The postal expenses needed for the request for the reimbursement of the connection expenses will be reimbursed, on request, based on the lowest-priority postal rate in force.
Article 10 : Rules of the Game
The rules can be sent free of charge (postal costs reimbursed on request), to any person asking "The Organiser" to send them.
"The Organiser" reserves the right to extend, cut short, amend or cancel the game at any time, particularly in the event of force majeure, without the Participants being able to claim any compensation.
Article 11 : Industrial and Intellectual Property
The reproduction, representation or use of all or part of the elements making up the game, including these rules, are strictly forbidden.
All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the site and on the sites to which the site allows access by means of hyperlinks are the exclusive property of their holders and are protected in this regard, on a worldwide basis, by the provisions of the French Intellectual Property Code (Code de la propriété intellectuelle). Their unauthorised reproduction constitutes an infringement punishable by criminal sanctions.
Any unauthorised full or partial reproduction of these trademarks, logos and signs constitutes an infringement punishable by criminal sanctions.
Participation in this game means the full and complete acceptance of these rules by the Participants.
Article 12 : Liability
"The Organiser" cannot be held liable in the event of force majeure or unforeseeable circumstances outside of its control.
"The Organiser" cannot be held liable and no legal action may be initiated against it in the event of the occurrence of events having the characteristics of force majeure (strikes, bad weather, etc.) partially or totally depriving the Participants of the possibility of taking part in the game and/or depriving the winners of the benefit of their Prize.
"The Organiser" and its service providers and partners may not, under any circumstance, be held liable for any incidents that might occur during the use of the Prizes by the beneficiaries.
Also, "The Organiser" and its service providers and partners may not be held liable for the loss or the theft of the Prizes by the beneficiaries if the winners have taken possession of them. The winners are fully responsible for any additional cost needed to take possession of the Prizes, without them being able to ask for any compensation from "The Organiser" or from the service providers or partners.
Article 13 : Disputes & Complaints
These rules are governed by French law.
"The Organiser" reserves the right to resolve, without appeal, any issue that may occur regarding the interpretation or the application of these rules, with it being understood that no objection will be allowed in particular regarding the terms and conditions of the game, the results, the winnings or the receipt thereof, one month after the end of the game.
Other than in the case of obvious errors, it is agreed that the information arising from the gaming systems of "The Organiser" constitutes conclusive evidence in any dispute regarding the connection data and the computerised processing of such information relating to the game.
Any complaint must be sent within one month of the end date of the game to
"The Organiser". Once this date has passed, no complaint will be accepted. Participation in the game means full acceptance of these rules.
Article 14 : Agreement in Relation to Proof
By express agreement between the Participant and "The Organiser", only the computer systems and files of "The Organiser" will be decisive.
The computerised records, stored in the computer systems of "The Organiser", at reasonable conditions of security and reliability, are deemed to be proof of the relations and communications between "The Organiser" and the Participant.
It is therefore agreed that, except in the case of an obvious error, "The Organiser" may, particularly for the purposes of proving any act, fact or omission, make use of programmes, data, files, records, operations and other elements (such as monitoring reports or other documents) of a computerised or electronic nature or in a computerised or electronic format or medium, drawn up, received or kept directly or indirectly by "The Organiser", in particular in its information systems.
The above elements thus constitute proof and, if they are produced as evidence by "The Organiser" in any legal or other proceedings, they will be admissible, valid and enforceable between the parties in the same way, at the same conditions and with the same conclusiveness as any document issued, received or kept in writing.
The operations of any sort carried out with the help of the user ID and the code allocated to a Participant, following registration, are presumed, indisputably, to have been carried out under the Participant's liability.
