1. Organiser and Object of the Competition
Fondation Louis Vuitton, whose registered head-office address is 8 avenue du Mahatma Gandhi, 75116, PARIS, registered under company registration number 494 685 761 (hereinafter "FLV"), is organising a photography competition entitled #MyFLV (hereinafter the "Competition")
FLV will select between five (5) and ten (10) photographs (The "Winning Photographs") depicting the architecture of the FLV building (taken inside or outside) and published by their authors on the INSTAGRAM application during the period of the Competition, according to the terms and conditions defined in these rules.
The Competition will run from May 3rd 2018 at 9 a.m. to 5 June 2018 at 11 p.m. inclusive, French time.
The Winning Photographs will be the subject of a digital and physical campaign, with the addition of the following mentions [#MyFLV – Thanks @[instagram accountname] for visiting ] on each photograph.
The Winning Photographs shall particularly be published on the FLV INSTAGRAM account [@FondationLV] and other FLV social networks (Facebook, Twitter), used for a physical campaign in the Paris underground and on kiosks, and possibly exhibited at FLV for the Heritage Days on 22 and 23 September 2018.
FLV is the sole organiser of the Competition.
2. Terms of entry
The Competition is open to all individuals, whatever their nationality, aged 18 or over on the date of opening of the Competition, with an Instagram account open before the Competition or during the period of the Competition (hereinafter "the Entrant").
Staff at FLV, the BETC agency and the bailiff's office cannot enter the Competition.
2.2 Public Instagram account
The Instagram account used by the Entrant for the Competition must be in "PUBLIC" mode. It must be strictly personal, no person other than the Entrant may use this account.
Each Entrant may use only one single Instagram account for the Competition.
FLV reserves the right to check that each Entrant properly meets these terms.
3. Terms and conditions of entry
Each Entrant may publish several photographs for the Competition.
To be considered by the jury, each Entrant's photograph must:
- Depict the FLV building, its internal or external architecture, excluding any other work exhibited at FLV;
- Not depict any identifiable person;
- Not be the result of any montage;
- Not contain any integration, even partial, of other photographs or of any other pre-existing element, protected or not by intellectual property rights;
- Have been taken less than six (6) months before the opening of the Competition;
- Have been personally taken by the Entrant;
- Not violate any current law or regulation;
- Not be contrary to public order and decency;
- Not violate the rights of a third party (particularly including intellectual property rights);
- Not have been submitted for another contest or competition, or published in a paper magazine;
The photograph must be in HD format and be taken in a minimum resolution of 300 dpi.
The Entrant guarantees that he/she is the sole holder of the rights to use the photograph submitted for the Competition, and that he/she has not assigned these rights, even on a non-exclusive basis, to a third party.
The Entrant undertakes not to, during the entire term of the Competition, use for commercial purposes the photograph submitted for the Competition.
3.2 Publication on Instagram
Each Entrant, to post his/her photograph, must comply with the following process:
- Log in to his/her Instagram account during the period of the Competition, from 3 May 2018 at 9 a.m. to 5 June 2018 at 11 p.m. inclusive, French time
- Follow the FLV Instagram account: @Fondation FLV;
- Publish online one or several photographs in accordance with these rules, accompanied by the hashtag #MyFLV and identify @FondationLV on each photograph.
- Maintain his/her Instagram account in "PUBLIC" mode (and not private).
The Entrant undertakes not to delete his/her photograph from his/her Instagram account during the term of the Competition.
The Entrant undertakes to use only a single Instagram account for the Competition.
Photographs not meeting these terms and conditions cannot be considered for the Competition.
3.3 Sharing on other social networks
The photographs submitted by the Entrants for the Competition shall be shared on the following FLV accounts:
Instagram – Twitter – Facebook
4. Jury and selection of winners
The jury shall be comprised of FLV representatives and chaired by the architect Frank Gehry (hereinafter "the Jury").
The Jury, after the Competition, shall select, from the photographs meeting all the terms defined in these rules, the Winning Photographs, taken by five to ten different Entrants.
The selection criteria shall be the following: originality and highlighting of the architecture of the FLV building.
The Jury's decision is firm and final. No objections regarding the Jury's decision shall be considered.
The 5 to 10 Entrants whose photographs shall have been selected (hereinafter "the Winners") must confirm acceptance of their selection by e-mail, to the following address: firstname.lastname@example.org, within a time limit of seven (7) calendar days from notification by FLV of the selection of the Winners.
The Winners must attach to their confirmation e-mail all the following documents/information:
- their full identity (surname, first name, date of birth, address)
- the assignment of the rights of use of their photograph to FLV, duly dated and signed, for which the template is accessible on the FLV website at the address www.fondationlouisvuitton.fr.
- the file corresponding to the selected photograph, in the format defined in point 3.1.
Only the submission of these elements will allow final confirmation of the Winner's selection.
Failing this, the Winner's selection may be cancelled.
In case of cancellation of the selection of one or several Winners, FLV may select one or several replacement Winners, or not select any other Winner.
The Winning Photographs shall be published on the FLV Instagram account between 18 June and 6 July 2018.
5. Competition prize
Each Winner whose selection shall have been confirmed shall be awarded the following prizes:
Each Winner shall become a Member of the FLV COLLECTOR Programme for a period of 12 months from 1stJuly 2018.
The Collector Programme includes:
A cocktail party for all the Winners whose selection shall have been confirmed, as well as FLV representatives shall be organised at the Le Frank restaurant.
The prize is strictly personal and nominative and may not be assigned or exchanged.
In case of a force majeure event, FLV reserves the right to replace the prize with a prize of equivalent type and value.
6. Following, modification and filing of Competition rules
Entry of the Competition constitutes unreserved acceptance of the entirety of these rules.
These rules have been filed at the office of the bailiffs SCP Denis Calippe - 416 Rue Saint Honoré, 75008, Paris.
The rules can also be consulted and downloaded free of charge on the website www.fondationlouisvuitton.frduring the entire term of the Competition.
FLV reserves the right, for any reason whatsoever, to modify the dates of the Competition, to postpone or cancel it, to modify its terms and/or terms and conditions of entry. Any amendments to these rules shall be published on the website of www.fondationlouisvuitton.fr and filed at the office of the bailiffs SCP Denis Calippe - 416 Rue Saint Honoré, 75008, Paris.
7. Intellectual property
The reproduction, depiction or use of any or part of the elements comprising the Competition are strictly prohibited.
All brands, logos, texts, images, videos and other distinguishing marks reproduced on FLV’s sites and social accounts, as well as on sites and social accounts to which they allow access via hypertext links, are exclusive property of their respective holders and are protected worldwide by the provisions of the French Intellectual Property Code. Unauthorised reproduction constitutes counterfeiting and is punishable by criminal sanctions.
Any total or partial unauthorised reproduction of these brands, logos and marks constitutes counterfeiting punishable by criminal sanctions.
FLV cannot be held liable in case of force majeure or act of God beyond its control, partially or totally preventing Entrants from entering the Competition and/or Winners from benefiting from their prize.
FLV cannot be held liable in case of direct or indirect damage resulting from use of the internet, the Instagram application or any other network.
The Entrant is personally liable for his/her connection to enter the Competition.
FLV cannot be held liable in case of fraudulent use of an Entrant's Instagram account.
When taking their photographs, Entrants must follow safety rules, whether inside or outside the FLV building.
9. Personal data
Personal data collected for the Competition shall be processed only by FLV to perform the rights and obligations resulting from the Competition and from its rules. It shall be retained for the time necessary to perform these rights and obligations.
In accordance with the French Data Protection Act (Loi n°78-17 Informatique et Libertés du 6 janvier 1978) as amended, Entrants have a right of access, correction, deletion, erasure, portability, and limitation of processing of personal data concerning them, by writing to the following address: Fondation Louis Vuitton, 8 avenue du Mahatma Gandhi, 75116, PARIS.
10. Reimbursement of costs of entry and viewing of rules
Costs relating to the Competition shall be reimbursed in accordance with the terms described below.
Access to the FLV Instagram account and entry of the Competition are entirely unrestricted and free of charge, meaning that connection costs, incurred by the Entrant, shall be reimbursed to him/her according to the following terms and conditions.
One single reimbursement per Entrant is allowed, on condition that the Entrant is a French resident and under normal use of Instagram, it being specified that it is specifically agreed that normal use of Instagram cannot exceed 15 minutes per day.
Since certain internet service providers offer internet users a free or unlimited connection, based on the currently available service offers and technical expertise, it is specifically agreed that any access on a free or flat-rate basis (such as connection by cable, ADSL or dedicated line) cannot be refunded, insofar as the subscription to the internet service provider's services is, in this case, taken out by the internet user for their general use of the internet and the fact that the entrant connects to enter the Competition does not cause him/her to incur any additional costs or expenses.
In case of paid connection billed in proportion to communication time, connection costs for entry of the Competition shall be reimbursed by cheque, on request from the Entrant sent within one month of disbursement of these costs, date as per postmark, within two months of receipt of the Entrant's request.
In the event of a connection subject to a lump-sum payment for a limited amount of time and, above this limit, billed in proportion to communication time, connection costs shall be reimbursed to the Entrant provided it is proven that the Entrant went over his/her limit and that the limit was exceeded because of connecting to enter the Competition. To obtain reimbursement of his/her connection costs, as well as postal costs for his/her reimbursement request, the Entrant must send FLV a written request, on loose paper, containing the following information:
- indication of his/her surnames, first name and personal postal address
- indication of the dates, times and durations of his/her connections to Instagram
- a copy of the itemized bill of the telephone operator and/or internet service provider to which he/she has subscribed, stating the dates and times of his/her connections to Instagram.
Postal costs necessary for the request to reimburse connection costs shall be reimbursed, on request, based on the current low-priority postal rate.
Any fees for entry to FLV to take photographs shall not in any case be reimbursed.
11 Agreement on evidence
The Entrant and FLV expressly agree that only FLV computer systems and files shall constitute valid evidence.
Computer logs, kept on FLV computer systems, under reasonable conditions of security and reliability, are considered as evidence of relations and communications between FLV and the Entrant.
It is therefore agreed that FLV may use, except in case of clear error, particularly for the purposes of producing evidence of any act, fact or omission, programmes, data, files, records, operations and other elements (such as monitoring reports or other statements) in computer or electronic form, in a computer or electronic format or on a computer or electronic medium drawn up, received or kept directly or indirectly by FLV, particularly in its computer systems.
The elements in question, if they are produced as evidence by FLV in any litigation proceedings or other proceedings, shall be admissible, valid and enforceable between the parties in the same manner, under the same terms and with the same probative force as any documents drawn up, received or kept in writing.
12. Settlement of disputes, governing law and jurisdiction
Entry of the competition constitutes full acceptance of these rules.
These rules are governed by French law.
Any dispute relating to their interpretation or to their performance that is not resolved amicably shall be referred to the competent courts in Paris.
