PREAMBULE

These general terms of sale apply between:

La Fondation d’entreprise Louis Vuitton, having its registered office at 8 avenue du Mahatma Gandhi, 75116 Paris, identified under company ID [SIREN] number 494 685 761 (hereinafter the “Foundation”). Telephone number: 01.40.69.96.00

AND

Any individual or legal person, as defined under the introductory Article, paragraph 1° or 2° of the French Consumer Code (Code de la consommation), making a purchase on its own behalf (hereinafter the "Purchaser") from the Foundation’s ticket office, or general admission ticket machines, or on the website www.fondationlouisvuitton.fr (hereinafter the “Website”).

These general terms of sale are intended to set out the terms and conditions for on-site and distance sales between the Foundation and the Purchaser, applicable to the Order, payment and delivery of individual general admission tickets, tickets for specific events (Live micro-visits, concerts, shows, family festival, individual visits, educational workshops, etc.), group tickets, and memberships (FLV Pass, Young Pass, Family Pass, Collector), (hereinafter referred to as the "Products" and each individually as a "Product").

These general terms of sale do not apply to the purchase of services outside the opening hours of the Foundation or to the purchase of entry tickets by persons who are not Purchasers.

Definitions:

"Order" refers to any order placed by the Purchaser of one or more Product(s) at the Foundation’s ticket office, general admission ticket machines, by mail or through the Foundation’s Website www.fondationlouisvuitton.fr.

“Product” refers to general admission tickets to the Foundation, tickets for specific events (LIVE micro- visits, concerts, shows, family festival, individual visits, educational workshops, etc.), group visits and memberships (FLV Pass, Young Pass, Family Pass, Collector).

The Products sold by the Foundation provide access to the Foundation's museum as well as the Jardin d’Acclimatation, during public opening hours. The Foundation does not offer tickets that provide access only to the Foundation's museum.

Information regarding all the Products is available on the Foundation’s Website.

"GTS": refers to these general terms of sale of Products, which are applicable to the placing and tracking of Orders. By placing an Order, the Purchaser agrees to comply with these GTS.

Before placing an Order on the Website, the Purchaser must firstly read these GTS, then confirm their agreement to all the GTS by performing the acceptance confirmation action required on the Website by clicking the "Validate and Pay" button.

In accordance with the provisions of article 1127-1 of the French Civil Code, these GTS may be retained by any person visiting the Website by computer record and may be reproduced by the Purchaser by printing them.

The Purchaser declares that they are at least 18 years old and have the legal capacity, or have received parental consent, to place an on-site or online Order for Products offered by the Foundation.

SECTION 1: SALE OF INDIVIDUAL GENERAL ADMISSION AND SPECIFIC EVENTS TICKETS (EXCLUDING MUSICAL EVENTS)

Article 1: Sale of general admission and specific event tickets

1.1  - Scope of application of section 1

Section 1 of these GTS applies to the sale of individual general admission and specific event tickets (excluding musical events) purchased from the ticket office, general admission ticket machines and/or the Foundation’s Website.

1.2  – Terms and conditions of sale of individual general admission and specific event tickets excluding musical events

1.2.1 - General admission to the Foundation Orders are placed:

Online on the Foundation's Website at the address: www.fondationlouisvuitton.fr.

General admission tickets may be ordered online only by date and time slots.

Sales are processed within the limit of the number of tickets allocated to a time slot.

When placing an Order on the Website, an Order summary page allows the Purchaser to verify that the selected tickets match their preferences, as well as the total price of the Order, before clicking the "Go to Payment" button. If the selected tickets do not meet the Purchaser's expectations, they have the option to cancel or modify their Order. By clicking the "Validate and Pay" button, the Purchaser will be deemed to have acknowledged and accepted these GTS and to have understood that their Order entails a payment obligation.

Once the Purchaser has validated their Order, the Foundation shall confirm receipt thereof without delay (unless justified) and by electronic means in accordance with article 1127-2 of the French Civil Code.

If the Purchaser does not receive confirmation of the acceptance or rejection of their Order by e-mail within a period of one (1) day, they must contact the Foundation by telephone on 01 40 69 96 00.

In accordance with the provisions of Article L. 221-28, 12° of the French Consumer Code, Purchasers are not entitled to cancel an Order.

From the Foundation’s general admission ticket office and ticket machines.

General admission tickets are on sale in the Foundation’s general admission ticket office and ticket machines from when the Foundation opens until half an hour before it closes.

When receiving the general admission tickets, the Purchaser should check that they match the Order.

In accordance with the provisions of Article L. 221-28, 12 of the French Consumer Code, Purchasers are not entitled to cancel an Order.

1.2.2 – Specific events (excluding musical events)

Orders are placed:

Online on the Foundation’s Website at the address: fondationlouisvuitton.fr

Sales of tickets for specific events (e.g., Family Festival, individual visits, educational workshops, etc.) made online are done exclusively by date and, where applicable, by time slots. The sale of specific event tickets is processed within the limit of the number of tickets allocated to each event, date and/or timeslots.

Orders for tickets for specific events may be placed from the date on which they go on sale given on the Foundation’s Website. The dates on which they go on sale may be modified by the Foundation without prior notice.

When placing an Order on the Website, an Order summary page allows the Purchaser to verify that the selected tickets match their preferences, as well as the total price of the Order, before clicking the "Go to Payment" button. If the selected tickets do not meet the Purchaser's expectations, they have the option to cancel or modify their Order. By clicking the "Validate and Pay" button, the Purchaser will be deemed to have acknowledged and accepted these GTS and to have understood that their Order entails a payment obligation.

Once the Purchaser has validated their Order, the Foundation shall confirm receipt thereof without delay (unless justified) and by electronic means in accordance with article 1127-2 of the French Civil Code.

For LIVE Micro-visits, the Purchaser must send an e-mail to the Foundation at the following address: visitelive@fondationlouisvuitton.com

From the Foundation’s general admission ticket office and ticket machines.

Specific event tickets are on sale in the ticket office and general admission tickets machines from when the Foundation opens until half an hour before it closes.

When receiving the tickets, the Purchaser should check that they match the Order.

Article 2: Price and payment

2.1  - Price of general admission and specific event tickets (excluding musical events)

The prices of general admission or specific event tickets (face value) are given in euros including tax. Tickets remain the property of the Foundation until full and final receipt of the price.

The price lists are available on the Website, click here. The Foundation reserves the right to modify the prices of general admission and specific event tickets at any time. However, any such modifications shall have no impact on the price of Orders that have already been placed.

2.2  - Payment of general admission and specific event tickets

Purchases from the Foundation ticket office of one or more tickets require a one-off payment by bank card (Visa / Mastercard, Carte Bleue, American Express or JCB), by cheque (payable to Fondation Louis Vuitton with presentation of a valid ID), or in cash.

Purchases from the Foundation general admission ticket machines are made only by bank card (Visa / Mastercard, Carte Bleue, American Express or JCB).

Purchases of tickets on the Website are made only by bank card (Visa, Mastercard, Carte Bleue, American Express or JCB).

The Foundation's online sales platform uses the See Tickets solution and the Adyen secure payment service (https://www.ayden.com/) with PCI/DSS certification.

Confidential data (16-digit credit card number and expiry date) is encrypted when transmitted from the Foundation website to the Adyen payment platform and is not stored, it is simply processed directly by the payment service. The Foundation guarantees that the encryption methods and services used to secure transactions have been authorized or declared by the encryption manager, in accordance with current legislation.

The price of the Order is debited when the payment is approved.

Any payment method not specified in these GTS shall be refused by the Foundation.

SECTION 2: SALE OF INDIVIDUAL TICKETS FOR MUSICAL EVENTS

Article 2.1: Ticket sales for musical events

2.1.1 – Scope of application of section 2 

Section 2 of these GTS applies to the sale of tickets for musical events (e.g., concerts, performances) purchased individually at the ticket office and/or via the Foundation's Website.

2.1.2 – Ticket sale conditions

Orders can be placed:

Online via the Foundation's Website at the following address: www.fondationlouisvuitton.fr

The online purchase of tickets for musical events is conducted exclusively by date. Sales are processed within the limit of the number of tickets allocated for a specific date.

Tickets can be ordered starting from the sales opening date indicated on the Foundation's Website. The Foundation reserves the right to modify sales opening dates without prior notice. When an event is sold out, tickets will no longer be available for purchase, and the event will be marked as "Full" on the website.

When making a reservation via the Website, an Order summary page allows the Purchaser to verify that the selected tickets match their preferences and to view the total price of the Order before clicking the " Go to Payment" button. Ticket sales and availability updates are processed in real time. If the number of tickets requested exceeds the number of seats remaining in the selected category, the number of tickets allocated cannot exceed the available seats in that category. If the selected tickets do not meet the Purchaser's needs, they may cancel or modify their Order. Until payment has been made, the Order is not final and does not constitute proof of a confirmed reservation.

By clicking the "Validate and Pay" button, the Purchaser will be deemed to have read and accepted these GTS, as well as to have understood that their Order entails a payment obligation.

Once the Purchaser has validated their Order, the Foundation will acknowledge receipt of the Order without delay (except in justified cases) and via electronic means in accordance with Article 1127-2 of the French Civil Code.

If the Purchaser does not receive confirmation or rejection of their Order by email within one (1) day, they should contact the Foundation by telephone at +33 (0)1.40.69.96.00.

In accordance with Article L. 221-28, 12° of the French Consumer Code, the Purchaser does not benefit from a right of cancellation.

At the Foundation's ticket office. Tickets for musical events are also available for purchase at the Foundation's ticket office from the Foundation's opening time until 30 minutes before its closing time. Upon receiving the tickets, the Purchaser must verify that they comply with their Order. In accordance with Article L. 221-28, 12° of the French Consumer Code, the Purchaser does not benefit from a right of cancellation.

The number of tickets per Purchaser, whether cumulative or by seating category, cannot exceed the number defined by the Foundation. Each Order for musical event tickets is limited to a total of eight (8) tickets per Purchaser: two (2) tickets at the membership rate and/or six (6) tickets at other rates. The Foundation reserves the right to refuse any unusual order exceeding the authorized number of tickets per Order or successive Orders within a thirty (30) calendar day period.

A certain number of Purchasers do not attend the musical events for which they have purchased tickets. To avoid empty seats in the auditorium, the Foundation offers additional tickets for sale. If access to the musical event cannot be provided under the conditions specified on the ticket, due to this reason, the Purchaser may request a full refund. Refunds will be processed using the same payment method used for the initial Order unless the Purchaser expressly agrees to a different method. In any case, the refund will not incur additional costs for the Purchaser.

The Foundation may modify the programs or castings of musical events. In such cases, tickets will not be refunded, exchanged, or returned.

If a concert is interrupted beyond half of its scheduled duration, tickets will not be refunded, exchanged, or returned.

Article 2.2: Prices and payment

 2.1.1    – Ticket prices for musical events

Ticket prices for musical events (face value) are indicated in euros, including all taxes. Discounts are available for Purchasers who are members of a membership schemes. Outside of these membership schemes, no discounts apply.

Ticket prices by seating category are presented on the event-specific page of the Foundation's Website, as well as at tickets vending machines and the ticket office. The Foundation reserves the right to modify ticket prices and seating categories at any time. However, such changes will not affect Orders already placed prior to the changes.

Proof of eligibility may be required at the time of ticket validation for tickets purchased at membership rates. This rate applies only to strictly nominative, non-transferable tickets without an accompanying guest.

Additional fees may apply depending on the ticket delivery method selected by the Purchaser.

Tickets remain the property of the Foundation until full and final payment is received.

2.1.2    – Payment for tickets for musical events

Purchases made at the Foundation's ticket office must be paid in full at the time of purchase via bank card (Visa, Mastercard, Carte Bleue, American Express, or JCB), bank check (payable to Fondation Louis Vuitton with presentation of a valid ID), or in cash.

For online ticket purchases, payment is only accepted by bank card (Visa, Mastercard, Carte Bleue, American Express, or JCB). The total Order amount is charged upon payment validation.

The Foundation's online sales platform uses the See Tickets solution and the Adyen secure payment service (https://www.adyen.com/), certified as compliant with PCI/DSS standards. Confidential data (16-digit card number, expiration date) is encrypted and transmitted securely from the Foundation's website to the Adyen payment platform. These details are not stored but handled directly by the payment service. The Foundation guarantees that the encryption methods and services used for transaction security comply with applicable legal regulations.

In exceptional circumstances and at the discretion of the Foundation, payment for an Order may be made via a secure payment link (e.g., PayByLink provided by the Adyen payment platform).

Any payment method not specified in these GTS will be refused by the Foundation.

SECTION 3: SALE OF GROUP VISITS

Article 3.1: Group visit bookings

3.1.1  - Scope of application of section 3

Section 3 of the GTS applies to sales of visits for school groups, solidarity groups, or groups with disabilities, after a reservation is made via the Foundation's Website (through a contact form), by email, or by telephone on 01 40 69 96 00.

3.1.2  - Visit booking terms and conditions

Bookings are processed within the limit of the number of group visits allocated to dates on which group visits are offered.

Bookings are made:

Online at the Foundation's website at the address: www.fondationlouisvuitton.fr.

School, solidarity, disabled group visits are booked using the online form in the dedicated group section on the Website. Bookings for school or solidarity group are made online only by time slots for the days of the week mentioned on the Website.

Payment is made prior to the visit or, exceptionally, on-site on the day of the visit at the Foundation's ticket office upon presentation of the visit confirmation sent by post or email.

In accordance with the provisions of Article L. 221-28, 12° of the French Consumer Code, Purchasers are not entitled to cancel an Order.

By telephone. Visits may be booked by telephone by contacting the call center on 01 40 69 96 00. Payment is made prior to the visit or, exceptionally, on-site on the day of the visit at the Foundation's ticket office upon presentation of the visit confirmation sent by post or email.

In accordance with the provisions of Article L. 221-28, 12° of the French Consumer Code, Purchasers are not entitled to cancel an Order.

From the Foundation ticket office. As an exception and at the discretion of the Foundation, group visits may be sold at the Foundation's ticket office from the opening of the Foundation until half an hour before closing.

Upon receiving the confirmation slip sent by post or email, the Purchaser should check that it matches the booking. 

Article 3.2: Price and payment

3.2.1    - Group visit prices

The prices of group visits are given in euros including tax. The price lists are available on the Website on the pages respectively dedicated to school group, solidarity group and group with disabilities.

The Foundation reserves the right to modify group visit prices at any time. However, any such modifications shall have no impact on the price of Orders that have already been placed.

2.2.2 - Group visit payment

Group visits are paid for:

  • prior to the visit by cheque or bank card (Visa/Mastercard, Carte Bleue, American Express or JCB) or, as an exception and at the discretion of the Foundation, through a secure payment link (e.g., PayByLink provided by the Adyen payment platform);
  • on the day of the visit, as an exception and at the discretion of the Foundation, at the Foundation's ticket office upon presentation of the visit confirmation sent by post or email. Payment for group visits at the Foundation ticket office must be made by a one-off bank card payment (Visa/Mastercard, Carte Bleue, American Express or JCB), by cheque (payable to Fondation Louis Vuitton with presentation of a valid ID) or in cash.

Any payment method not specified in these GTS shall be refused by the Foundation.

SECTION 4: SALE OF MEMBERSHIPS

Article 4.1: Membership orders

 4.1.1  - Scope of section 3

Section 3 applies to the sale or renewal of the four membership schemes offered by the Foundation: “FLV Pass”, “Young Pass”, “Family Pass” and “Collector”. These membership schemes are ordered from the Foundation’s ticket office or Website in the membership section.

4.1.2  - Terms and conditions for the sale of memberships Orders are placed:

Online on the Foundation’s Website at the address: fondationlouisvuitton.fr, in the section dedicated to memberships schemes, available here.

Orders for memberships are placed using the online form in the membership section. Sales are processed within the limit of the number of memberships defined by the Foundation.

Orders for memberships may be placed from the date on which they go on sale given on the Foundation Website. The dates on which they go on sale may be modified by the Foundation without prior notice.

When placing an Order on the Website, an Order summary page allows the Purchaser to verify that the selected subscription match their preferences, as well as the total price of the Order, before clicking the "Go to Payment" button. If the selected subscription does not meet the Purchaser's expectations, they have the option to cancel or modify their Order. By clicking the "Validate and Pay" button, the Purchaser will be deemed to have acknowledged and accepted these GTS and to have understood that their Order entails a payment obligation.

Once the Purchaser has validated their Order, the Foundation shall confirm receipt thereof without delay (unless justified) and by electronic means in accordance with article 1127-2 of the French Civil Code.

If the Purchaser does not receive confirmation of the acceptance or rejection of their Order by e-mail within a period of one (1) day, they must contact the Foundation by telephone on 01 40 69 96 01.

Right to cancel an Order:

In accordance with the provisions of article L.221-18 of the French Consumer Code, Purchasers are entitled to cancel an Order without giving any reason within a period of fourteen (14) days from entering into the contract of sale.

To exercise the right of cancellation, Purchasers must notify the Foundation using the contact information provided in the preamble to these GTS of their decision to cancel an Order by means of a clearly worded statement (for example, a letter sent by post or e-mail). Purchasers have the option of using the cancellation form provided in Annex to the present GTS, but this is not mandatory. In order to comply with the cancellation period, Purchasers must send their statement regarding the exercise of the right of cancellation before the expiry of the cancellation period.

Effects of cancellation:

If the Purchaser cancels an Order, the Foundation shall reimburse all payments received, including any eventual delivery fees for the subscription (excluding any additional costs incurred in the event the Purchaser selected a delivery method other than the least costly standard delivery method proposed by the Foundation) without undue delay and, in any event, no later than fourteen (14) days from the day the Foundation was informed of the Purchaser's decision to cancel an Order. The Foundation shall refund the Purchaser using the same payment method used by the Purchaser for the initial transaction unless the Purchaser expressly agrees to a different method. In any event, the Purchaser will not be charged any additional fees for the refund.

If the Purchaser wishes to use their subscription before the end of the cancellation period, they must make an express request to this effect on the Foundation website by e-mail to the following address “contact@fondationlouisvuitton.fr ” or by letter at the address provided in the preamble.

If the Purchaser exercises their right to cancel and they have started to use their subscription upon their express request before the end of the cancellation period, they must pay the Foundation an amount corresponding to the service provided until they informed the Foundation of the decision to cancel their Order.

From the Foundation’s ticket office. Subscriptions are on sale from the Foundation’s ticket office from when the Foundation opens until 5 pm, on days when the Foundation is open to the public. The Foundation’s public opening dates and hours are available on the Website, please click here.

The different membership schemes provide benefits for their holders, which are detailed on the dedicated page of the Website for each option: for the FLV Pass: click here; for the Family Pass: click here; for the Collector Pass: click here; and for the Young Pass: click here.

The Foundation reserves the right to modify the membership schemes as well as the benefits associated with each scheme at any time. However, such modifications will not affect Orders previously placed.

Article 4.2: Prices and payment

4.2.1 - Membership prices

Membership prices are given in euros including tax. The price lists are available on the Website, click here.

The Foundation reserves the right to modify the membership prices at any time. However, any such modifications shall have no impact on the price of Orders that have already been placed.

4.2.2 - Membership scheme payment

Memberships purchased on the internet must be paid for using an online form in the membership section. Payments are made online by bank card (Visa/Mastercard, Carte Bleue JCB or American Express).

The Foundation's online sales platform uses the See Tickets solution and the Adyen secure payment service (https://www.ayden.com/) with PCI/DSS certification.

SECTION 5: PROVISIONS APPLICABLE TO ALL PRODUCTS

Article 5.1: Modification and cancellation

The Foundation reserves the right to modify its cultural program if the conditions required to be able to propose it as scheduled have not all been met.

In case of cancellation of an event by the Foundation, except in an event of force majeure as defined in article 1218 of the French Civil Code, the face value of the ticket paid by the Purchaser to the Foundation shall be refunded to the interested party, within a maximum period of fourteen (14) days from the sending of the non-invalidated ticket to the Foundation by the Purchaser along with their bank details (full bank details or bank or American Express card number with its expiry date).

Insofar as possible, the Foundation agrees to report these cancellations or modifications of exhibitions and events to Purchasers either by reporting it on the Website or by sending informative messages by e-mail to the address given at the time of purchase.

Article 5.2: Receipt of tickets or membership cards

5.2.1 - Receipt of tickets

In order to receive tickets at a preferential rate, the Purchaser must submit relevant proof. Tickets are provided in the chosen form:

Printable by the Purchaser via the email received after payment for the Order has been confirmed online. This email contains a download link for each ticket purchased. Each ticket purchased corresponds to a PDF file.

Home-printable tickets are available at all times until the date of the event indicated on the Foundation's Website.

The home-printable ticket allows the Purchaser to print the purchased tickets on a standard printer via Internet access. To be valid, the ticket must be printed in portrait orientation (vertical), without resizing, on a blank, white A4 sheet, printed single-sided.

The Foundation's home-printable tickets are equipped with a unique barcode. The validity of tickets is verified and recorded at the entrance using barcode readers. Admission to the Foundation is not possible multiple times with the same ticket. Ticket reproduction is prohibited. Altered, copied, or counterfeit tickets will not grant access to the Foundation.

The Foundation is not obligated to verify the identity of the person presenting the home-printable ticket to confirm that they are the original Purchaser of the ticket, nor to verify the authenticity of the home-printable ticket, insofar as imitation or copying cannot be categorically identified during entry control.

Digital Tickets (M-tickets): these are available via the email received after payment confirmation for the Order online and presented digitally as an image (e.g., on a smartphone). Each ticket purchased corresponds to a PDF file. Altered, copied, or counterfeit tickets will not grant access to the Foundation.

Digital tickets are available at all times until the date of the event indicated on the Foundation's Website.

Issued from the Foundation’s ticket office or general admission ticket machines: when they are purchased on-site, tickets are issued at the Foundation's ticket office or ticket machines. No copies or duplicates will be provided in case of loss, alteration, or theft of the tickets.

For the purchase of LIVE Micro-visits, the Purchaser will receive a personalised confirmation from our partner My Tour Live prior to the visit containing the access link and instructions to follow.

To take full advantage of the LIVE Micro-visit, the Purchaser must be equipped with a good quality Internet connection (5 Mbps downstream minimum recommended) and use a compatible web browser on Mobile or PC (Chrome, Firefox or Safari).

5.2.2 – Receipt of membership cards

Members subscribing online will be able to download a temporary electronic ticket whilst awaiting postal delivery of their permanent membership card. Membership cards are dispatched within 3 to 15 working days from the date of order. Each card is provided as a PDF file. The cost of posting membership cards is included in the price of the chosen package.

For the digital membership card to be valid, it must be printed in landscape (horizontal) mode, without altering the print size, on a blank white A4 sheet that is blank on both sides. Each membership purchased corresponds to one temporary electronic ticket.

Members subscribing on-site will receive their membership card immediately.

5.3 – Terms of use of tickets or membership cards

 Tickets and membership cards cannot be returned, refunded (including in case of the loss or theft of tickets), exchanged, or resold.

Any holder of a ticket or membership card purchased as part of a Foundation offer agrees, at the risk of potential legal action, not to use it for any promotional or commercial purposes whatsoever. In particular, except with specific permission from the Foundation, any sale, resale or exchange of tickets or membership cards is strictly prohibited at the risk of the penalties specified in the French Criminal Code. Admission to the Foundation may be refused in the event of a failure to present relevant proof for tickets or membership cards at preferential rates.

5.4 – Complaints

Any complaints must be submitted in writing and sent to the Foundation at the following address: Direction des publics / Fondation Louis Vuitton / 8 Avenue du Mahatma Gandhi, 75116 Paris. For any time limits, the postmark shall be considered as legally binding.

Purchasers who benefit from special terms of admission to cultural events by the Foundation, pursuant to agreements between the Foundation and a partner (theatre, museum, transport company, etc.) cannot under any circumstances hold the Foundation liable for failures by the aforementioned partner to meet their obligations.

5.5 - Personal data on the Foundation website

The Foundation, acting as data controller, has created an electronic file listing certain personal data regarding the Purchaser (surname, first name, e-mail address) collected when creating their account. This information is necessary for the management of orders and monitoring of customer relationships, as well as for the organization of commercial marketing operations (sending of newsletters, Product information, special offers and other marketing activities), subject to the Purchaser’s consent, where applicable.

The collected data is intended for the Foundation’s sales and marketing department and its eventual sub-processors.

The Purchaser’s data is deleted three years after the last transaction is registered with the account. The Foundation has appointed a data protection officer who is at [Data Subjects’] disposal. In accordance with the French data protection law no.78-17 of 6th January 1978 as amended and the General Data Protection Regulation no. 2016/679/EU of 27th April 2016, the Purchaser has the right to access, rectify and delete all or part of their personal data. The Purchaser also has the right to object to processing on legitimate grounds, a right to limit processing, and to the portability of personal data, and the right to provide instructions for after their death. For processing based on consent, the Purchaser may withdraw their consent at any time. The Purchaser can exercise these rights upon simple request, accompanied by a copy of their ID by e-mail at the address dpo@fondationlouisvuitton.fr.

The Purchaser is informed that they also have the possibility of bringing a claim before the CNIL (The French National Commission for Information Technology and Civil Liberties).

Furthermore, in accordance with article L.223-1 of the French Consumer Code, the Purchaser has the possibility of registering on a telemarketing Do-Not-Call list.

5.6 – Entirety of the contract

If any of these GTS are declared inapplicable for any reason whatsoever, this shall not affect the application of the other provisions of these GTS, with the provision deemed inapplicable being then replaced by a provision as similar as possible.

5.7 – Liability

Neither the Foundation nor the Purchaser shall be held liable for any non-performance due to an event of force majeure as defined by article 1218 of the French Civil Code.

Similarly, the Foundation shall not be liable for any use by a third party of the Products ordered and delivered to the Purchaser; the latter shall be solely responsible for the use of such Products.

5.8 – Applicable law – settlement of disputes

These General Terms of Sale are governed by French law.

In the event that a dispute should arise between the Foundation and the Purchaser in connection with the performance or interpretation of these GTS, the Purchaser shall be entitled, before any legal proceedings, to find an amicable solution and to contact the CMAP – Paris Mediation and Arbitration Centre, the consumer mediator for the Foundation.

To submit a dispute to the mediator, the Purchaser can fill in the form on the CMAP website: www.cmap.fr under the "you are: a consumer" tab, send their request by simple or registered letter to: CMAP Médiation Consommation

Regardless of the means used to contact the CMAP, the Purchaser’s request must contain the following elements to be processed promptly: their postal and e-mail address, telephone number and the full name and address of the Fondation Louis Vuitton, a brief statement of the facts, and proof of the steps taken by the Purchaser with the Fondation Louis Vuitton prior to referring the matter to the CMAP (It is specified that the Purchaser must provide proof of having attempted to directly resolve their dispute with the Foundation by written complaint (Cf. Article 5.4).

The European Commission provides an Online Dispute Resolution Platform for online contracts of sale or service between a consumer residing in the European Union and a professional established in the European Union. This platform can be accessed at the following address: https://webgate.ec.europa.eu/odr/.

The Purchaser must submit their request to the mediator within a period of one (1) year from their written complaint to the Foundation.

The mediation clause only applies when the user is acting as a non-professional. The use of mediation is an alternative mechanism which is not a precondition for legal action. The Purchaser remains free to initiate, accept or reject the use of mediation. In the event of mediation, the parties remain free to accept or reject the solution proposed by the mediator. In the event of failure, any dispute regarding the GTS and the Foundation and the Purchaser shall be brought before the competent French courts.

5.9 - Modification of the General Terms of sale

The Foundation reserves the right to adapt or modify these GTS at any time. In case of modification, the General Terms of Sale applicable on the date of the Order shall be applied to the Order.

The French version of the GTS, available here, shall prevail over the English version in case of any doubt regarding their interpretation.
