Rules of the contest

“Merry New Year celebrations” at the Fondation Louis Vuitton

ARTICLE 1: ORGANISATION

The Fondation Louis Vuitton, hereinafter “The Organiser”, the registered office of which is located in PARIS, 16ème, Bois de Boulogne, 8 avenue du Mahatma Gandhi, identified in the SIREN under the number 494 685 761, is organising a free contest without a purchase obligation, (hereinafter the “Competition”) the 24 and 25 December 2021, according to the terms of these rules. 

ARTICLE 2: PARTICIPANTS

This free contest, without a purchase obligation, is open to adults or minors, residing in France or any other country.

The following are excluded from the contest: staff members of “The Organiser”, and all persons who have directly or indirectly participated in designing, executing, or managing the contest as well as their spouse and family members, direct descendants and ascendants or other relatives, whether or not they live with them. 

“The Organiser” reserves the right to ask any participant (hereinafter the “Participant” or “Contestant”) to prove the conditions set out above. Any person that does not fulfil these conditions or refuses to prove them shall be excluded from the Competition and shall not be able to receive the prize in case they win. “The Organiser” reserves the right to carry out any verification concerning the compliance with this rule.

Participation in the contest implies complete acceptance of these rules.

ARTICLE 3: TERMS OF PARTICIPATION

To participate in the Competition, the Contestant has to visit the Instagram account of Fondation Louis Vuitton. They also have to follow the account of the Fondation (@fondationlv) and complete this three conditions in a single commentary on the publication associated at the Competition :

  • To Comment on the publication “Merry New Year celebrations”.  
  • To tag (mention) the username of an Instagram user
  • To answer the following question in the comments: “In which artwork of the Morozov Collection would you like to immerse yourself?

Every person who meets those three criteria will be eligible for the lucky draw.

The Participant is informed and agrees that the information entered in the "post" is proof of his/her identity.

Any participation contrary to the provisions of these rules shall render the participation invalid. Any Participant suspected of fraud may be excluded from the contest by "The Organiser" without any justification. Any identification or participation that is incomplete, erroneous or illegible, whether intentionally or not, or carried out in a form other than that provided for in these rules shall be considered invalid. The same penalty shall be applied in case of multi-participation.

ARTICLE 4: WINNINGS

The prize at stake is:

  • Five (5) x two (2) tickets for visiting the Fondation Louis Vuitton, valid during one year from receipt of the tickets. (“Prizes”)

The Prices are provided by exclusively the Fondation Louis Vuitton.

ARTICLE 5: DECIDING THE WINNERS

A lucky draw will be held between all the Participants who have complied with the terms and conditions of participation set out in article 3.

Five Participants will be drawn at random. Each will win a Prize i.e. two tickets to visit the Louis Vuitton Foundation valid for one year as defined in article 4. (hereinafter "The Winners").

The Winners shall be announced on 25 December 2021 on our Instagram page.

ARTICLE 6: ANNOUNCING THE WINNER

The names of the Winners shall be posted in a story on the Fondation Louis Vuitton’s official account and in the comment of the Contest post.

The Winners shall then be contacted via private message in order to share their personal contact details with The Organiser (mailing address, surname, first name) that will allow it to send them the Prize.

ARTICLE 7: AWARDING THE PRIZE

Each Winner undertakes to accept the Prize as offered without the possibility of exchange, particularly for cash, other goods or services of any nature whatsoever, or transfer of the benefit to a third party. Likewise, this Prize shall not be the subject of any requests for compensation.

“The Organiser” reserves the right, in case of an event beyond its control, particularly related to its suppliers or unforeseeable circumstances, to replace the prizes announced with prizes of equivalent value. The Winners shall be informed about any changes.

ARTICLE 8: PERSONAL DATA OF PARTICIPANTS

The personal data collected as part of the Contest shall be processed solely by “The Organiser” to execute the rights and obligations resulting from the Contest and its rules. They shall be stored for the amount of time required to execute these rights and obligations.

The Winners authorise “The Organiser” to post his/her surname and first name on the Website, without this conferring on him/her any remuneration, right, or advantage whatsoever, other than the awarding of his/her Prize.

Pursuant to the Regulation (EU) 2016/679 of the European Parliament and of the Council dated 27 April 2016, all Participants have the right to access, rectify, delete, erase, portability, and limit the processing of their personal data, by sending an email to the following address dpo@fondationlouisvuitton.fr or by writing to Fondation Louis Vuitton, 8 avenue du Mahatma Gandhi in PARIS, 16th district. 

ARTICLE 9: RULES OF THE CONTEST

The rules of the contest are posted on the Website of Fondation Louis Vuitton : https://www.fondationlouisvuitton.fr/fr and may be addressed free of charge to any person who requests them from "The Organiser" (stamp reimbursed on request).

“The Organiser" reserves the right to extend, shorten, modify, or cancel the contest at any time, particularly in the event of force majeure, without the Participants being entitled to any compensation.

ARTICLE 10: INDUSTRIAL AND INTELLECTUAL PROPERTY

Reproducing, representing, or using all or part of the elements constituting the contest, including these rules, is strictly prohibited.

All trademarks, logos, texts, images, videos, and other distinctive signs reproduced on the Website as well as on the sites to which it allows access through hyperlinks, are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code throughout the world. Their unauthorised reproduction constitutes an infringement punishable by criminal penalties.

Any unauthorised reproduction, in whole or in part, of these trademarks, logos, and signs constitutes an infringement punishable by criminal penalties.

Participation in this contest implies the full and complete acceptance of these rules by the Participants.

ARTICLE 11: LIABILITY

“The Organiser” shall not be held liable in the event of force majeure or fortuitous event beyond its control that partially or entirely deprive the Participants of the possibility of participating in the contest and/or the Winners of the benefit of their Prize.

“The Organiser” and its service providers and partners can in no way be held liable for any incidents that may occur during the use of the Prize by the Winners.

Similarly, “The Organiser” as well as its service providers and partners cannot be held liable for the loss or theft of the Prizes by the Winners once the Winners have taken possession thereof. Any additional cost necessary to take possession of the Prizes must be borne entirely by the Winners without being able to request any compensation from either “The Organiser” or the partner or service provider companies. 

ARTICLE 12: AGREEMENT OF PROOF

By express agreement between the Participant and “The Organiser”, the computer systems and files of “The Organiser” shall be the sole evidence.

The computerised records, stored in the computer systems of "The Organiser", in reasonable conditions of security and reliability, shall be considered as proof of the relations and communications between "The Organiser" and the Participant.

It is consequently agreed that, except in the case of an obvious mistake, "The Organiser" may use, particularly for the purposes of proof of any act, fact, or omission, the programmes, data, files, recordings, operations, and other elements (such as follow-up reports or other statements) of digital or electronic nature or in a digital or electronic format or medium, established, received, or stored directly or indirectly by "The Organiser", particularly in its computer systems.

The elements considered thus constitute proof, and if they are produced as means of proof by "The Organiser" in any contentious procedure or other procedure, they shall be admissible, valid, and enforceable between the parties in the same way, under the same conditions, and with the same evidential value as any document that would be established, received, or stored in writing.

Operations of any kind carried out using the identifier and code allocated to a Participant, following registration, shall be irrefutably presumed to have been carried out under the liability of the Participant.

ARTICLE 13: DISPUTE & CLAIM

“The Organiser” reserves the right to settle, without appeal, any difficulty that may arise as to the interpretation or application of these rules, it being understood that no dispute shall be admitted, in particular as to the terms and conditions of the contest, results, winnings, or their receipt, one month after the end of the contest.

Except in the case of obvious mistakes, it is agreed that the information from the contest systems of “The Organiser" has evidential value in any dispute as to the login details and data processing of said information relating to the contest.

These rules are governed by the French law.

Any claim must be addressed to "The Organiser" within one month of the end of the contest. After this date, no claim shall be accepted. Participation in the contest implies complete acceptance of these rules.
